Construct Data AG taken to court

Trade fair organisers are still warning exhibitors and members about the continuing activities of the Austrian publishing house Construct Data AG, which publishes the Fair Guide web directory. By their timing ahead of a trade fair and by their visual appearance, the forms sent out for this give the impression that they offer a free entry in the official directory of exhibitors of the trade fair organiser, although the entry is in fact charged for and is unconnected with the organiser of the stated trade fair. Although a number of companies that suffered losses have apparently successfully sued the Austrian publisher, a large number of complaints are still being received by the Austrian association for protection against unfair competition. For that reason, the association has decided to take legal action against Construct Data AG to prevent them sending out Fair Guide forms and collecting debt-claims, AUMA reports. The lawsuit is initially limited to the European Union plus Switzerland because the legal situation is largely uniform in that zone. However, if this test case is successful, the action may be extended to other countries.
