1. Scope of Terms and Conditions
These Terms and Conditions ("Terms”) govern the contract relationship between the expo-gate GmbH and natural and legal persons using services of Messe1x1.de
Messe1x1.de (German version) and fairevents.com (English version) is an Internet service operated by expo-gate GmbH for companies, organizations, associations and individuals, who provide products or services in the field of trade fairs, act as an exhibitor at fairs or present their business at similar events. In addition Messe1x1.de operates a job portal for the exhibition and event industry.
2. Use and Performance
2.1 Tenders
Messe1x1.de is an internet portal that offers a market platform to service providers ("service provider") and service consumers ("tender/s") in the fields of trade fair construction, exhibition staff, catering and logistics to establish contacts and business transactions between service providers and tenders. In this regard Messe1x1.de only acts as broker to make contacts between the tender and the service provider, who needs to be listed and qualified as certified service provider. A qualified service provider is a company with an existing and officially released company website, have a properly-run entity and can demonstrate relevant, proven expertise in the specified service areas. Messe1x1 will check this information for accuracy before registering the service provider.
Once a service provider has been registered (free of charge), he will receive all incoming tenders from Messe1x1.de by e-mail alerts. The service provider can view the contact details of the exhibitor and detailed information about the tender by clicking on the link contained in the email alert. By clicking on the link, a contract between the service provider and Messe1x1.de will be concluded automatically. Once Messe1x1.de has sent the details of the tender to the service provider, Messe1x1.de has fulfilled its obligations and a fee will be charged to the service provider.
Within the placement of contacts by Messe1x1.de, the service providers and/or tenders have no claim against Messe1x1.de on the conclusion of a contract or the implementation of performance between the tender and the service provider. Placing enquiries is free of charge for tenders and entails no obligation to assign an order to a service provider for the tender. The assignment of orders and the selection among potential service providers is exclusively entitled to the tender. Anyhow, the tender confirms a serious interest and planning of a project or exhibition due to its specifications in the call to tender. A call to tender with the very objective of budget calculation is not permitted and will be rejected by Messe1x1.de. Messe1x1.de reserves the right to verify the information provided by the tender before sending out the call to tender to the service providers to ensure the accuracy and sincerity of the information. To verify the data and to support the tender Messe1x1.de will get in touch with the tender before placing a tender.
2.2 Job market
Messe1x1.de offers a job market on its web portal for the trade fairs, convention and event industry. This service is available to job seekers to search for vacancies free of charge. The placing of job applications is free of charge for four weeks (except cipher advertisements;
see additional fees under our fee checklist. The placing of a job posting on the web portal of Messe1x1.de by a tender will be charged. A job posting will be placed based on the advertisement order sent by the client via online order form.
A publication of the advertisement will only be guaranteed as long as all information (all required fields filled in) is provided, the content is reasonable and only in line with the objectives, which are published on the web portal of Messe1x1.de. Messe1x1.de will verify the content and information of job providers / - seekers to its best of care and knowledge, but is not liable for content placed by third-parties. Messe1x1.de reserves the right to reject orders if an order violates laws, regulatory regulations or if the publication is seen as not reasonable.
The processing period of advertisement orders is usually three business days. If the payer has not made any information on the release date, the publication will be made as soon as possible. If the cipher function is not activated, the corporate or personal data will be displayed on the published advertisement.
For the use of the job market, certain personal data (name, address, e-mail address, etc.) will be required from the job providers / - seekers. These data will solely be used by Messe1x1.de for the purpose to make contacts between job providers and job seekers. The user agrees to the use of his/her data by entering data to the contact form.
2.3 Miscellaneous
2.3.1 Media data and special products
In addition to the general products mentioned so far, Messe1x1.de offers clients special products free of charge and billable. Subject to charge are banners, button advertising, newsletter ads, directory entries of headings as fair marketing, exhibition information and various trade fair checklists.
The relevant terms and conditions as well as the product-related conditions of the cooperation partners of Messe1x1.de apply for exhibition services additionally.
3. Fees and Payment Methods
3.1 Costs
The use of Messe1x1.de as information platform is free of charge. Cost only effect to customers who have decided for a billable entry or services not free of charge. The respective costs are available under our fee checklist. All prices are net prices plus VAT. Clients will be invoiced. Accounts are to be settled immediately and without deduction. Messe1x1.de reserves the right to mark up on a reasonable scale. Price adjustments will be updated in our fee checklist and published on the web portal.
3.2 Default of payment
If a customer does not settle an account or is unable to pay within 10 days from the due date and after receipt of invoice, it will be automatically in default of payment. Once a customer is in default of payment, Messe1x1.de can deactivate job postings and/or application for posts, advertisements, customer entries and disable the transmission of tender alerts irrespective of any other claims. In case of default of payment handling expanses will be charged with a lump sum of EUR 30 (plus VAT) for every clients’ order. Messe1x1.de is furthermore entitled to assign claims out of the contractual relationship to third parties.
4. Correctness and availability of information offered
Information on the pages of Messe1x1.de (e.g. company data, presentations of products, trade show dates, services and references, links, articles, discussion papers, selling ads and requests) are approved and partially created by third parties. The operator does not guarantee the origin and veracity of such information and data and is in no way liable for false or misleading information. Similarly, the operator can not guarantee that links refer to the stated target sites or that linked sites contain suspected content.
The user is in no event entitled to compensation or restitution in any form against the operator, if a loss of information or a disadvantage arose by the use, purchase, use or transfer of a product offered at Messe1x1.de. The operator can not be held liable, should - in whatever form and kind - a tangible or intangible damage was caused to a user or customer. The operator acts always to the best of its knowledge and belief.
Messe1x1.de reserves the right not to publish the activation of entries and content or to refuse - even without prior notice or reasons - if the content violates legal regulations, is immoral or can not be admitted due to objectively justified reasons or if otherwise not reasonable. Furthermore Messe1x1.de can deactivate or delete already published data.
It is in no way guaranteed, and is not explicitly promised that the use of Messe1x1.de is possible at any time and various services are always available. There is no legal entitlement to availability of the system of Messe1x1.de.
5. Final Clause
Messe1x1.de reserves the right to modify these terms at any time and for any reason. The revised conditions are published on the web portal.
If parts or individual parts of these terms are invalid, further terms are left in fact valid. In place of the invalid provisions the effective provisions will supersede, which fulfils the commercial success best possible. The same applies to the case that gaps in these terms and conditions should be revealed.
